Statement by Dr. Ezekiel Mutua, MBS – Chief Executive Officer, Music Copyright Society of Kenya (MCSK) on the status of the Company.

Dear Members and Stakeholders,
The leadership stalemate at MCSK, stemming from the listing of new directors in CR12 in June 2024 and the prolonged tenure of some former directors, has significantly hindered the Society’s operations. This situation has undermined democracy and good governance principles, leaving MCSK unable to serve its members effectively.
To resolve this impasse, I have initiated an Alternative Dispute Resolution (ADR) process with the concerned parties. To this end, a Memorandum of Understanding (MOU) has been signed with the CR12 team, and agreements have been reached with other stakeholders to address outstanding issues, including withdrawing the plethora of cases in court.
It will be recalled that during the Extraordinary General Meeting held on 16th February 2024 at Maanzoni Lodge, it was resolved that all directors serving at that time were to retire and seek re-election, except for two regional directors—Lazarus Muli (Eastern) and Simon Kariuki Nderitu (Central)—who were to continue for one year. Their terms ended on 16th February 2025 and the two cannot therefore transact any business on behalf of MCSK. This has occasioned a leadership vacuum that must be resolved urgently to restore smooth operations at MCSK.
The ADR efforts we have initiated aim to restore stability while safeguarding the interests of MCSK members, staff security, and the Society’s overall welfare. I am optimistic that these efforts will yield positive results and pave the way for nationwide elections soon.
I therefore appeal for your understanding, cooperation, and support as we work toward resolving this leadership crisis.
